FUNDAMENTALS OF THE LEGAL SYSTEM AND FUNDAMENTAL RIGHTS

The course offers an introduction to the fundamentals of public law, analysing the system of regulatory sources and the role of national and supranational institutions. It examines the organisation and functions of Parliament, Government and public administration, as well as the mechanisms of protection, with a focus on fundamental rights and freedoms.

Course Topics
Institutional foundations of public law; the system of normative sources in the national and supranational context; the role of national and supranational public institutions; activities and organization of institutions, with particular reference to the Parliament, the Government, and public administration; the protection system within the legal order; focus on fundamental rights and freedoms.

Teaching format
The lesson takes place in synchronous remote mode.

Educational objectives
Knowledge and Understanding: - Basic knowledge of the public legal system, with particular attention to its relevance in social service contexts. - Ability to understand and interpret legal sources at the national, European, and international levels, particularly in relation to the protection of fundamental rights and the functioning of public institutions. - Knowledge of the Italian Constitution, with a focus on fundamental principles, citizens' rights and duties, and the organization of public powers, also from an educational perspective. - Understanding of the principles of administrative activity and the functioning of public administrations in relation to educational and social services. Applying Knowledge and Understanding: - Ability to identify, retrieve, and use relevant legal sources, especially in the context of social services. - Ability to provide basic support to public entities regarding current legislation and the protection of rights. - Ability to analyze concrete cases related to fundamental rights or the functioning of institutions, applying public law principles with awareness. Making Judgment: - Ability to collect, understand, and assess relevant legal data to form independent judgments on issues related to public law. - Skills in critically analyzing content from updated legal sources by consciously applying the concepts and principles of public and constitutional law, with particular attention to fundamental rights. Communication Skills: - Ability to clearly and effectively express learned legal concepts using sufficiently appropriate technical language. - Willingness and ability to engage in reasoned discussion and to communicate key legal issues concerning rights and public institutions. Learning Skills: - Development of tools and methodologies useful for independently deepening legal topics addressed in the course, including for further academic study or professional development.

Additional educational objectives and learning outcomes
- Foster an integrated view of public law in educational and social contexts, enhancing its role in promoting inclusion and gender equality. - To enhance awareness of the link between legal norms and institutional realities, with particular attention to the impact on individuals and communities. - To support the development of an interdisciplinary approach in the study of law, in dialogue with the social and pedagogical sciences.

Assessment
Written examination with open-ended questions (100 % of the final grade). For attending students: 1. written mid-term exam (33 % of the final grade); 2. written final examination (67% of the final grade).

Evaluation criteria
The answers to the questions will be evaluated based on the following criteria: - Relevance and accuracy in relation to the question; - Completeness and critical understanding; - Clarity of exposition and appropriate use of legal terminology; - Argumentative ability; - Independent judgment and ability to connect the acquired knowledge.
