Juvenile and Family Law

The course aims to illustrate the legal system for the protection of minors and the legal regulation of family relationships.
The study of the sources (national, Community and international) will be followed by an analysis of the fundamental institutions that contribute to delineating the system of family legal relations in our legal system, with particular reference to emerging problems and the issues most debated in practice.

Course Topics
- history and evolution of family law; - judicial protection and jurisdictional bodies; - administrative protection; activities and functions of social services; - marriage, personal and property relations between spouses; - civil unions and cohabitation; - procreation and filiation; - parental responsibility; parents' rights and duties; - interventions on parental responsibility; - custody and adoption; - family crisis: separation and divorce, with special attention to child custody; - minor age; - minor's capacity; - status and rights of the child; - criminal protection of the child and the family - the juvenile offender and the juvenile penal system

Educational objectives
The course aims to provide students with - the general elements of knowledge of family and children's law; - the essential tools of legal language; - the knowledge of how to document regulatory sources, doctrine and case law; - the ability to interpret examples drawn from work reality with the notions of family and juvenile law. Disciplinary objectives of the course - knowledge of juvenile and family law - knowledge of the basic elements of juvenile and family law Disciplinary skills Knowledge and understanding - of the principles, rules and operational tools of juvenile and family law. Ability to apply knowledge and understanding - to concrete cases in professional practice; - in the use of textbooks on juvenile and family law, juvenile and family law; - in the study of regulatory sources and case law. Transversal/soft skills Autonomy of judgement - to be able to approach juvenile and family law topics in legal and professional terms - to be able to reflect on the legal topics covered by the course and to be able to relate them to the future professional role. Communication skills - to be able to use legal language relating to social issues and to be able to identify in examples/situations of practice the applicable legal framework; - to be able to communicate information, ideas, problems and solutions. Learning skills - to navigate juvenile and family law legal texts - possess adequate skills both to devise and support arguments and to address issues and problems in juvenile and family law

Assessment
Oral test

Evaluation criteria
For the oral test, the following are considered and assessed - relevance of knowledge and degree of thoroughness; - clarity of exposition and command of legal language; - argumentative skills; - critical analysis and re-elaboration.

  • It is necessary to be familiar with the current provisions of the Italian Civil Code concerning the covered topics.
