The Labour Law course provides students with an in-depth and analytical knowledge of the legal sources and regulatory frameworks that influence labour relations at national, European and comparative levels. Particular attention is given to recent developments in Italian labour law, with a focus on the evolution of the concept of flexibility. Through the analysis of practical cases, students learn to apply legal rules in real-life contexts, while developing the capacity for autonomous reasoning and the mastery of appropriate legal terminology.

The course also promotes the learning skills necessary for further academic or professional advancement in the field.

Themen der Lehrveranstaltung
The topics covered will be as follows: 1) The historical evolution of Italian labour law and the most recent reforms of Italian labour law; 2) The sources of Italian labour law and the role of ILO, EU and ECHR law; 3) Trade union law and industrial relations; 4) Autonomy and subordination; 5) The employment relationship; 6) The essential characteristics of the standard employment relationship; 7) The concept of flexibility and atypical employment contracts; 8) Anti-discrimination law.

ILO (Intended Learning Outcomes) ILO 1 Knowledge and understanding ILO 1.1 knowledge of the public and private legal system, also with reference to economic and business studies ILO 1.2 knowledge and ability to interpret the sources of law, with regard to the various sectors of the legal system: public, private, commercial and tax, in the European, national, regional and international contexts ILO 1.3 understanding of the legal framework regulating relations between private individuals and between private individuals and public bodies ILO 1.4 knowledge of the law of persons, property, transfer of rights to property and the law of obligations, contract and liability ILO 1.5 knowledge of company law also open to international guidelines ILO 2 Ability to apply knowledge and understanding ILO 2.1 being able to provide support to companies and corporate bodies through knowledge of the relevant area of law ILO 2.2 be able to analyse cases arising in professional experience and apply the appropriate rules of the legal field concerned

Bildungsziele und erwartete Lernergebnisse (zus. Informationen)
Ability to integrate interdisciplinary approaches: develop the competence to link legal instruments with economic, social and comparative dimensions in order to understand the impact of regulations on the economic and social fabric. Dispute resolution skills: acquire the ability to apply tools for the management of labour and trade union conflicts. Ethical awareness and social responsibility of the jurist: to develop a critical understanding of the role of the jurist in contemporary societies, with attention to the values of legality, sustainability and social justice.

Art der Prüfung
Students attending the course will be assessed as follows: written midterm or final examination: 80%; active participation in class: 20%. Non-attending students will be assessed solely on the basis of the final written examination (100%). ILOs assessed 1 and 2

Bewertungskriterien
The following are relevant for the assessment of the written examination: the clarity of answers, the command of language (knowledge of technical-legal language and grammatical and logical command of language), the ability to summarise, evaluate and establish relationships between arguments.
